Newest DUI Laws in 2007

Beginning in September of 2007, new Arizona DUI laws increase jail time for those convicted of extreme DUI (a blood alcohol concentration of 0.15 or greater). Previously, judges were able to use their discretion to reduce a jail sentence from 30 days; that is no longer the case. Furthermore, there would be regular monitoring for 30 days, designed to prevent the individual from consuming any alcohol. This time period may be extended by a judge. These newest laws make it more imperative than ever to consult with a qualified DUI attorney after being charged.

First DUI Offense

If you've been pulled over for a DUI and it's your first offense (assuming a BAC of less than 0.15), DUI sentences in Arizona demand that you, if convicted, receive a minimum mandatory jail sentence of one to ten days with a maximum term of six months. You also face a fine ranging from $250.00 to $2500.00 plus surcharges, as well as a probation term of up to five years.

You also face a driver's license suspension or restriction. This usually occurs for a term of up to ninety days. However, if you refused to take a breathalyzer test, you stand to have your driver's license suspended for an entire year.

Second DUI Offense

If you receive a second DUI offense within five years of your previous one, new DUI sentences in Arizona require that you receive a longer mandatory jail term of thirty to sixty days with a maximum of six months. The new DUI sentences in Arizona also require a driver's license revocation for a minimum of one year. Revocation is not the same as suspension. With revocation, your driver's license is not automatically reinstated after the revocation expires. In addition, you must have a certified ignition interlock device installed on every personal automobile for a period of at least one year.

Extreme DUI

If your BAC (blood alcohol content) is determined to be over the statutory limit of 0.15%, you will be charged with an extreme DUI. The new DUI sentences in Arizona require a person charged with an extreme DUI serve a minimum of thirty days in jail and a fine ranging from $500.00 to $2500.00 plus surcharges. You may also be placed on probation and have your license suspended. You will also be required to install an ignition interlock device on your automobiles after your license is reinstated.

Aggravated DUI

If you are arrested and charged with an aggravated DUI, you are now charged with a class 4 felony, which carries a minimum prison term of four months. Also, prison with this type of charge is a condition of probation. This is a very serious charge and thus the sentences are going to be much harsher than the other types of DUI's. The new DUI sentences in Arizona also demand that your driver's license be revoked for three years. Your automobiles also must be equipped with an ignition interlock device and your car could also be subject to forfeiture to the State of Arizona.
